This appeal arises from a suit Cushman & Wakefield of Texas, Inc. ("Cushman") filed for lease brokerage commissions allegedly due it from Northborough Corporate Limited Partnership, L.L.P. ("Northborough"). Although both parties moved for summary judgment, the court granted Cushmans motion. Northborough now appeals both that decision and the trial courts denial of Northboroughs own motion for summary judgment.
