Order The Secretary of Health and Human Services (HHS) formerly Health, Education and Welfare (HEW) has appealed to this court from an order of the district court granting a preliminary injunction requiring HHS to renew an annual grant of support to plaintiff North Memphis Community Health Organization (NMCHO), under Section 330 of the Public Health Services Act, 42 U.S.C. § 254c. NMCHO had received successive grants to support its operations from July 1972 to November 30, 1979. HHS declined to award NMCHO a continuation grant after November 30, 1979, when the budget and projects periods of its grant expired. It contends that the decision of HHS not to award it a continuation grant without affording it prior notice and a hearing violated its due process rights under the Constitution of the United States as well as its own policies, procedures and regulations.
